Under and by virtue of the power of sale contained in a certain Deed of Trust to Karen J. Glascock, Trustee(s), dated February 4, 2005, and recorded among the Land Records of Somerset County, Maryland in Liber 595, folio 748, rerecorded in Book 611, Page 266, the holder of the indebtedness secured by this Deed of Trust having appointed the undersigned Substitute Trustees, by instrument duly recorded among the aforesaid Land Records, default having occurred under the terms thereof, and at the request of the party secured thereby, the undersigned Substitute Trustees will offer for sale the fee simple lot of ground and improvements thereon, situated in Somerset County, Maryland, described as follows:
ALL THAT LOT OR PARCEL OF LAND situate, lying and being in Tangier Election District, Somerset County, Maryland, and being fully shown and described on the hereinafter referred to plat and beginning for the same at the letter "A" on said plat; thence,
1] North 18 degrees 05 minutes West 44.65 feet to an iron pipe;
2] North 30 degrees 15 minutes East 206 feet to an iron pipe;
3] South 59 degrees 30 minutes East 86.63 feet to an iron pipe;
4] South 26 degrees 51 minutes West 164.49 feet to an iron pipe;
5] South 71 degrees 55 minutes West 95 feet by and with Haines Point Road to a concrete post and the place of beginning.
Said parcel containing 19,148 square feet, more or less, as shown on a plat entitled “Resubdivision of Lot - Richard W. and Jane A. Ellis” by Richard W. Cooper, dated June 8, 1988, and recorded among the aforesaid Land Records in Liber 376, Folio 1068.
The property will be sold in “AS IS WHERE IS” condition without either express or implied warranty or representation, including but not limited to the description, fitness for a particular purpose or use, structural integrity, physical condition, construction, extent of construction, workmanship, materials, liability, zoning, subdivision, environmental condition, merchantability, compliance with building or housing codes or other laws, ordinances or regulations, or other similar matters, and subject to easements, agreements, and restrictions of record which affect the same, if any. The property will be sold subject to all conditions, liens, restrictions, and agreements of record affecting the same, including any condominium and HOA assessments pursuant to Md. Real Property Article 11-110.
