By virtue of the power of sale contained in a Deed of Trust to ASEEM MITAL, Trustee, dated June 6, 2006, and recorded in the Land Records of Prince George's County, Maryland in Liber 26032, Folio 502, the holder of the indebtedness secured by this Deed of Trust having appointed the undersigned Substitute Trustees, and upon default occurring under the terms of the Deed, at the request of the party secured, the undersigned Substitute Trustees will offer for sale the following described property:

Property Description:
ALL THAT LOT OF GROUND SITUATE IN PRINCE GEORGE'S COUNTY, MARYLAND, AND DESCRIBED AS FOLLOWS:
Lot No. 1, as shown on a subdivision plat entitled "Virginia Davis Subdivision," recorded in Plat Book NLP 135, Plat 97, among the Land Records of Prince George's County, Maryland.
This property is located in the 4th Election District of Prince George's County, Maryland.

The property will be sold in "AS IS WHERE IS" condition, without any express or implied warranty or representation, including but not limited to the description, fitness for a particular purpose, structural integrity, physical condition, compliance with applicable laws, zoning, subdivision, environmental condition, merchantability, or other similar matters. The property will be sold subject to easements, agreements, and restrictions of record, including any condominium or HOA assessments pursuant to Md Real Property Article 11-110.

Terms of Sale:

  • A deposit of $47,000 is required at the time of sale, payable in certified or cashier's check.

  • The balance of the purchase price must be paid in immediately available funds upon final ratification of the sale by the Circuit Court of Prince George's County, Maryland.

  • Interest will be charged on the unpaid purchase money at a rate of 6.875% from the date of sale to the date of settlement.

  • The secured party, if a bidder, is not required to post a deposit.

  • A third-party purchaser (excluding the secured party) must complete settlement within 10 calendar days of the ratification by the Circuit Court. Failure to do so will result in the forfeiture of the deposit, and the property may be resold at the defaulting purchaser's risk and expense.

  • All public charges, private charges, assessments (including water/sewer charges), ground rent, and taxes will be adjusted to the date of sale.

  • The purchaser will bear the cost of documentary stamps, transfer taxes, and all other costs associated with settlement.

  • If applicable, condominium or homeowner association dues and assessments will be adjusted to the date of sale.

  • If the sale is rescinded, not ratified, or if the Substitute Trustees are unable to convey insurable title, or a resale occurs, the purchaser’s sole remedy will be a refund of the deposit.

  • The purchaser waives all rights and claims against the Substitute Trustees, whether known or unknown. These provisions will survive settlement. Upon refund of the deposit, the sale will be void, and the purchaser will have no further claim against the Substitute Trustees.

  • The sale is subject to a post-sale review of the loan status. If any agreement to cancel the sale was entered into by the lender and borrower prior to the sale, the sale will be void, and the purchaser’s deposit will be refunded without interest.
